Battle of Bats – General Terms and Conditions (event on March 7, 2026, at Grand Prairie Cricket Stadium, Dallas, TX)
1. Organizer and Contract Basics
• These Terms form the contract between Battle of Bats ("Organizer") and the purchaser or holder ("End Customer" or "Ticket Holder") of Tickets or related Offers.
• All communications: Battle of Bats, contact@battleofbats.com .
• The event uses vivenu technology/services; vivenu is only a platform provider, not the Organizer or a party to the contract. No contract exists between End Customer and vivenu.
• Contract forms only upon Organizer confirmation (e.g., ticket ID issuance). Purchases are final; Organizer may reject/refuse sales or revoke Tickets for any legal reason (including quota issues, with refund of face value).
• Total price (face value + fees/taxes/surcharges) is set by Organizer and shown before payment.
2. Tickets
• Tickets delivered via email (digital link); must be presented in the specified form (e.g., mobile/digital wallet). Order confirmation email alone is not valid for entry.
• Printed Tickets may be available for extra fee.
• Verify Ticket details (quantity, date, etc.) immediately; report issues to Organizer within 5 business days.
• Ownership transfers only on full payment. Provide accurate info; Organizer may verify details.
3. Entry and Participation
• Valid electronic Ticket required for entry (one per person aged 3+; minors need adult supervision).
• Organizer may refuse/revoke entry or eject without refund for breach of these Terms, suspected abuse, non-compliance, or safety risks.
• Tickets valid only for this single-day event (specific time/place/seat if assigned). Invalid after event ends.
• Lost/damaged Tickets: Notify Organizer promptly; no replacement guaranteed.
4. Ticket Transfers
• No resale, exchange, or transfer except personal, non-commercial transfer to known guests at no more than face value (no profit/business gain).
• No use for promotions, packages, auctions, prizes, or commercial purposes without written Organizer approval.
• Breach makes Ticket void; Organizer may cancel/confiscate without refund and request proof of purchase/identity.
• To re-assign/personalize: Contact Organizer (fee may apply).
5. Refunds, Cancellation, Changes
• All sales final. No refunds/exchanges except as stated here or required by law.
• Refund of face value (not fees/taxes) only if:
o Event cancelled and not rescheduled; or
• No refund for delays, shortened play , weather, view obstructions, or relocation to comparable seat.
• Organizer may change time/date/venue/seat at its discretion; refund only if rescheduled to new date/venue and you cannot attend.
• Organizer not liable for uninterrupted view, weather protection, or event content/duration.
6. Liability and Risks
• Organizer liable only for intentional/gross negligence (or as required by non-waivable law); limited to transaction value for slight negligence. No liability for force majeure, third parties, or vivenu service issues.
• Ticket Holder assumes all risks of attending (injury, death, illness including COVID-19, property loss, etc.) and releases/waives claims against Organizer, venue, teams, sponsors, etc. ("Released Parties").
• Indemnifies Released Parties for any damage caused by Ticket Holder.
• Mandatory binding arbitration for disputes (JAMS, California, Delaware law, individual basis only; no class/jury trial).
7. Conduct and Prohibitions
• Comply with venue health/safety rules, searches, and Code of Conduct (no abuse, intoxication, disruption, discrimination, standing blocks, etc.).
• No unauthorized recording/transmission, betting data collection, drones, ambush marketing, or prohibited items (weapons, glass, alcohol outside rules, etc.).
• Breach may result in ejection, ban, or legal action without refund.
• By entry, Ticket Holder grants Organizer irrevocable license to use their image/likeness/voice for any purpose.
8. Miscellaneous
• Laws of Organizer's state of incorporation apply (CISG excluded).
• For non-consumers: Exclusive jurisdiction at Organizer's registered office.
• Privacy: Data used per Organizer's policy (https://www.battleofbats.com/privacy ).
• These Terms prevail; severable if any part invalid.
By purchasing/using a Ticket, you agree to these Terms for yourself and your guests.
